The Proponent submitted a response to the Office of Coordinator General for submissions received from the Public and Government Agencies including from the Department of Sustainability, Environment, Water, Population and Communities (SEWPaC) formerly (DEWHA) with regards to the Environment Protection and Biodiversity Conservation Act (EPBC Act).

The Coordinator General has prepared a report of his findings and submitted the report to the Department of Sustainability, Environment, Water, Population and Communities (SEWPaC) for assessment against the EPBC Act.
If the CG's report is supported by SEWPaC then The Cassowary Coast Regional Council will determine the application for issue of a Development Application (DA).
The Proponent is also required to apply for a permit to upgrade Ella Bay Road from the Wet Tropics Management Authority (WTMA) for those parts of the road that are located within the World Heritage Area.
